ADJUSTMENT OF
STATUS

Adjustment of Status Steps

    1. Eligibility:

  • Ensure that you are eligible to apply for adjustment of status. Common eligibility categories include family-sponsored petitions, employment-based petitions, refugee/asylee status, and certain other special programs.
  • 2. File an Immigrant Petition:

  • A family member or employer must file an immigrant petition on your behalf. This petition establishes the qualifying relationship or employment basis for your adjustment of status.
  • 3. Check Visa Bulletin:

  • Monitor the Visa Bulletin issued by the U.S. Department of State to determine whether a visa number is available for your category and priority date.
  • 4. File Form I-485:

  • Once a visa number is available, you can file Form I-485, Application to Register Permanent Residence or Adjust Status, with U.S. Citizenship and Immigration Services (USCIS).
  • 5. Biometrics Appointment:

  • Attend a biometrics appointment, where USCIS will collect fingerprints, photographs, and your signature for background check purposes.
  • 6. Attend an Interview (if required):

  • USCIS may schedule an interview to discuss your application, verify information, and assess your eligibility for adjustment of status. Not all applicants are required to attend an interview.
  • 7. Receive a Decision:

  • USCIS will review your application and supporting documents. If approved, you will receive a Notice of Approval, and your green card will be mailed to you.
  • 8. Conditional Permanent Residency (if applicable):

  • In some cases, if your green card is based on a marriage that is less than two years old at the time of approval, you may initially receive conditional permanent residency. You will need to file a petition to remove the conditions later.
  • 9. Receive Green Card:

  • Once your application is approved, you will receive your green card, granting you lawful permanent resident status in the United States.

It's important to note that the specific requirements and processes may vary depending on the immigration category and individual circumstances. Consulting the official USCIS website or seeking legal advice is recommended for accurate and up-to-date information. Additionally, immigration laws and procedures can change, so staying informed is crucial throughout the process.
